BY SIGNING BELOW YOU AGREE TO THESE CONDITIONS AND YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT.

TO: ESCAPE ENIGMA (hereinafter referred to as “Escape Enigma”).

ASSUMPTION OF RISKS

I am aware that entering the Escape Enigma premises, participating in the puzzles, engaging in entertainment with others and activities related to the escape rooms concept (hereinafter collectively referred to as the “ACTIVITIES”) involve many risks, dangers and hazards including, but not limited to: falling or slipping; collision with other persons; confrontations with other persons; assault by other persons; loss of balance or control; negligence of other persons; and negligence on the part of Escape Enigma or its staff. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF ESCAPE ENIGMA OR ITS STAFF TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES.

I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH THE ACTIVITIES AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH AND PROPERTY DAMAGE AND LOSS RESULTING THEREFROM.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, INDEMNITY AGREEMENT AND LICENCE

In consideration of Escape Enigma accepting my registration, booking an escape cube experience online, on the phone or in person, and permitting my use of its facilities (hereinafter referred to as “the facilities”), I hereby agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against Escape Enigma, and its owners, directors, officers, employees, agents, representatives, volunteers, sponsors, successors and assignees (all of whom are hereinafter collectively referred to as “THE RELEASEES”), and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer, or that my next of kin may suffer resulting from either my use of or my presence on the facilities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE UNDER THE OCCUPIERS’ LIABILITY ACT, ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF THE ACTIVITIES REFERRED TO ABOVE;
   
   
2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any damage to property of or personal injury to any third party, resulting from my use of or presence on the facilities;
   
   
3. This Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;
   
   
4. The Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of Alberta and no other jurisdiction;
   
   
5. Any litigation involving the parties to this Agreement shall be brought solely within the Province of Alberta and shall be within the exclusive jurisdiction of the Courts of the Province of Alberta; and
   
   
6. In entering into this Agreement I am not relying upon any oral or written representations or statements made by the Releasees with respect to the safety of the activities other than what is set forth in this Agreement.
   
   
7. Escape Enigma and its employees, agents and contractors may take my photograph, or create an image, video, portrait or likeness of me in any other manner, for use by Escape Enigma in its promotional materials and advertising in all forms and in any media, and I hereby consent to the use by Escape Enigma of any such photograph, image, video, portrait, or likeness for such purposes. I waive any right to approve or edit such photograph, image, video, portrait or likeness. If I am attending as part of a group booking for a business event, I represent that I am authorized to, and do hereby grant Escape Enigma a non-exclusive, royalty-free, worldwide license to use the business’ name and its logo in promotional materials and advertising of Escape Enigma business and services in any form and in any media.

Terms & Conditions

All participants are subject to the following terms and conditions:

1. You shall not enter the facilities under the influence of drugs or alcohol. Failing this Escape Enigma, and any employee or agent of Escape Enigma, shall reserve all rights and power to decline or refuse your entry to the facilities. If you are found to be under such influence, Escape Enigma, their employee, or agent shall have the power, authority and consent expressly granted by you to take the necessary legal action to ensure reputation of the business remain intact and guard against any risk or harm towards the site, the Escape Enigma brand and business, employees, or other customers. All losses, damages or legal costs derived from such incident shall be solely borne by you.
   
   
2. You agree not to carry or bring any dangerous, harmful or hazardous object on/in to the facilities, including, but not limited to, sharp objects, explosive items, weapons, or any item deemed to be dangerous or harmful to other visitors on the facilities. In the event that such item or object is found, Escape Enigma, their employee or agent shall have the power, authority and consent expressly granted by you to decline or refuse your entry to the facilities, or eject you from a game  already in progress.
   
   
3. You agree to behave, conduct, perform, carry out, execute, achieve and complete the game in accordance to the instruction, command and rules specified by Escape Enigma, failing which Escape Enigma, their employees, or agent shall have the right and power to decline or refuse your entry to the facilities, or eject you from a game already in progress.
   
   
4. All items including, but not limited to, your personal belongings, objects, luggage, baggage, watches, wallets, mobile devices, items and/or property, shall be kept by you at your sole risk. In any event, Escape Enigma, their employees, or agent shall not be held liable or responsible for any loss of your personal belongings within the facilities or outside of the facilities. The risk of loss for your personal belongings shall be borne by you upon entrance on the facilities or engagement with the Escape Enigma business.
   
   
5. You shall not be allowed to record, capture or snap any photograph, video, film, tape or audio recording whatsoever before, during and after the game, except with the explicit permission of Escape Enigma. If such recording activity is found within the facilities, Escape Enigma, their employee, or agent shall reserve the power, authority and consent expressly granted by you to delete, remove or transfer such recording to any device, media or hardware owned by Escape Enigma, the copyright of such recordings will deemed automatically granted by you to Escape Enigma.
   
   
6. You have expressly agreed to participate, join, enter, use, play and/or access the escape room facilities at your sole risk. To the fullest extent permissible by applicable law, Escape Enigma disclaims all warranties, express or implied, including but not limited to, implied warranties, merchantability or fitness for the operation of the games. Escape Enigma does not warrant the reliability, accuracy, completeness, current or error-free of the product, content and materials included, used or deployed at the facilities. If a product, content or material is not as described, you have expressly waived the right to claim any damages and/or losses including but not limited to direct, indirect, incidental, punitive and consequential damages deriving from such use or reliance of the description of the product, content or material.
